5. Itinerary Changes & Route Availability
- Itineraries are planned based on typical road and weather conditions but may need to be modified due to road closures, landslides, weather, or safety concerns β particularly for seasonal routes like Kunzum Pass (typically open mid-June to early October only).
- We will make reasonable efforts to inform you in advance of any known route restrictions before your trip and to suggest suitable alternatives.
- Once on the trip, our drivers/team may modify the day’s plan for safety reasons; such changes are made in the traveler’s interest and are not grounds for a refund.
6. Traveler Responsibilities
- Travelers are expected to be ready at the agreed pickup time; excessive delays may affect the day’s itinerary and are not the responsibility of Dream Plan Spiti.
- Travelers must follow reasonable safety instructions given by drivers or expedition marshals, particularly during off-road sections, river crossings, or high-altitude stretches.
- Any damage caused to the vehicle due to traveler negligence or misconduct will be chargeable to the traveler.
- Travelers are responsible for their own travel insurance, particularly for high-altitude and off-road trips.
7. Vehicle, Driver & Service Standards
- We aim to provide well-maintained vehicles suited to hill and high-altitude conditions.
- In case of a vehicle breakdown, we will make reasonable efforts to arrange a replacement vehicle as soon as possible; minor delays caused by such circumstances do not entitle the traveler to a refund, though we will assist in minimizing disruption to your itinerary.
- Drivers reserve the right to refuse to proceed on a route if they assess it as unsafe due to weather, road conditions, or other factors.
8. Liability & Limitations
- Dream Plan Spiti is not liable for delays, losses, or damages caused by circumstances beyond our reasonable control, including but not limited to weather conditions, road closures, landslides, political disruptions, or government restrictions.
- We are not liable for personal injury, illness (including altitude sickness), loss of personal belongings, or damage arising from the traveler’s own actions or failure to follow safety instructions.
- For 4×4 self-drive expedition participants, liability for vehicle damage during self-driven sections rests with the driving traveler, except where caused by a pre-existing vehicle defect on our part.
- Our total liability, where applicable, is limited to the amount paid for the specific service booked.
[This section in particular should be reviewed by a lawyer to ensure it’s enforceable under applicable Indian consumer protection law and appropriately balances traveler protections with reasonable business limitations.]
9. Weather, Road Closures & Force Majeure
Spiti Valley and surrounding high-altitude routes are subject to unpredictable weather, seasonal road closures (particularly Kunzum Pass), landslides, and other natural events. In such cases:
- We will attempt to modify your itinerary, suggest an alternate route, or reschedule where possible.
- Where a trip cannot proceed due to such circumstances, we will work with you on a fair resolution (rescheduling or partial refund based on costs already incurred), but full refunds cannot be guaranteed given costs already committed on our end (vehicle booking, permits, etc.).
10. Permits & Documentation
- Travelers are responsible for carrying valid photo identification throughout the trip, as required at checkpoints.
- Foreign nationals are responsible for obtaining any required Inner Line Permits (ILP) for restricted areas; we can assist with guidance on this process but final responsibility rests with the traveler.
- Any delays or denial of entry due to missing/invalid documentation are the traveler’s responsibility.
11. Luggage & Personal Belongings
- Travelers are responsible for their own personal belongings throughout the trip.
- We recommend not leaving valuables unattended in the vehicle at any point.
- Vehicle luggage capacity varies by vehicle type β please confirm luggage requirements at the time of booking, especially for group trips or trips involving trekking/photography equipment.
12. Health & High-Altitude Travel
- Spiti Valley involves high-altitude travel (up to 15,000+ ft in places), which carries inherent health risks including altitude sickness.
- Travelers with pre-existing health conditions should consult a doctor before booking a high-altitude trip.
- Our drivers and guides carry basic first-aid and oxygen support where applicable, but this does not substitute for proper medical care, which may not be readily available in remote areas.
- We strongly recommend comprehensive travel insurance covering high-altitude travel and emergency evacuation.
13. Photography & Media
- We may photograph or video trips for promotional purposes (website, social media, marketing materials).
- If you do not wish to be featured in such media, please inform us in writing before or during your trip, and we will honor your request.
14. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of India. Any disputes arising from bookings with Dream Plan Spiti will be subject to the jurisdiction of the courts in [your city/district, Himachal Pradesh].
